This situation gave rise to the birth of Healthcare Professionals Union, to serve the interest of all Locum/Agency workers, including Doctors, Nurses/Midwives, Healthcare Assistants and other Allied healthcare professionals against unfair and unjust policies and regulations, and to protect the right of its members in workplaces.
What IR35 means IR35 is tax legislation that is designed to combat tax avoidance by workers supplying their services to clients via an intermediary, such as a limited company, but who would be an employee if the intermediary was not used. Such workers are called ‘disguised employees’ by Her Majesty’s Revenue and Customs (HMRC) HOW IR35 HAS AFFECTED NURSES AND ALL LOCUM HEALTHCARE PROFESSIONALS WORKING WITH THEIR PERSONAL SERVICES COMPANY.
Many healthcare professionals working as locum choose to work for clients using their own limited companies, sometimes referred to by the taxman as ‘personal service companies’. They do so for many reasons, often because clients and recruitment agencies wound only hire them as self-employed, which leaves locum health workers outside of IR35
As self-employed qualified healthcare professionals are faced with unavoidable financial risks. Locum healthcare workers often have to travel miles away from their permanent homes to cover shifts, having to lodge in hotels and apartments for the duration of their contracts.
